Creator Likeness Terms

This Digital Twin agreement ("Creator Terms") is between EverTwin, Inc., a Delaware corporation ("EverTwin"), and you, the creator. It adds to our Terms of Service and Privacy Policy; if they conflict on your likeness, these Creator Terms win. You accept them by ticking "I agree to the Digital Twin agreement" in the app and recording your consent statement.

1. Eligibility and identity

• You must be at least 18, and the face and voice you provide must be your own.
• You agree to verify your identity with an ID document and selfie. Our team checks every twin before brands can see it.
• If you are under contract with an agency, network or brand that limits your endorsements, you confirm that joining EverTwin doesn't break it.

2. What you license

You grant EverTwin a non-exclusive, worldwide, revocable licence to:

1. use your photos, intro video, voice recording and consent recording ("Source Material") to create and maintain an AI model of your face and voice ("Twin");
2. use your Twin to make videos for brands that you, or your settings, approve; and
3. sublicense those videos to each brand within the licence you approve: the markets, categories, channels, term and any exclusivity it states.

You keep all rights in your name, likeness and voice. EverTwin doesn't get the right to use your Twin for its own advertising without your separate written consent, except to show your public creator profile and intro video to brands on EverTwin.

3. Your rules

• You choose your markets, the categories you allow, brands you block, your prices and your review mode. Some categories (medical claims, alcohol, tobacco and vaping, gambling, weapons, adult content and politics) are always blocked and you can't unblock them.
• Scripts are written inside your rules. Your Twin will never claim you personally bought, used or got results from a product unless you agree that it's true.
• Every sponsored video is labelled as an ad and as AI-generated where the law or the platform requires.
• Once our team approves your Twin it is locked, so brands get a consistent face and voice. To change your photos, voice or rules, send a change request in the app.

4. Review and approval

Depending on the review mode you choose, you approve each brand's licence request, each video, or let videos inside your rules publish automatically. You can change your review mode at any time for future videos.

5. Payment

• Brands pay the prices you set (licence, exclusive and post fees) or the revenue share you offer. You receive 70% of what the brand pays for each deal; EverTwin keeps 30% as its fee.
• Earnings are shown in the app and paid monthly to the payout method you set, once any payment hold for the deal has passed. You are responsible for your own taxes, and we may ask for tax forms before paying you.
• If a brand's payment is reversed or refunded, the related earnings may be reversed too.

6. Exclusivity

If you accept an exclusive deal, you won't license your Twin to a competing brand in the same category, in the same markets, during that deal's term. Your own off-platform work is up to you unless the deal says otherwise.

7. Pausing and revoking

• Pause: ask to pause in the app. While paused, brands can't send new requests and no new videos are made. Active licences continue unless you revoke them.
• Revoke: you can revoke a brand's licence for a good reason, such as a breach of your rules. New videos with that brand stop at once, and the brand must take down live ads using your Twin within 7 days.
• Leave EverTwin: you can close your account at any time. No new licences start, existing licences run to the end of their term (or end sooner if you revoke them), and we then delete your Twin and Source Material as described in the Privacy Policy.

8. Your data

Your Source Material and ID are stored privately, used only for your Twin and identity checks, and never shown or given to brands. Brands receive only finished videos. See the Privacy Policy for details and your rights.

9. Your promises

You confirm that the Source Material is of you, that you are free to grant this licence, and that the information in your profile (including follower counts) is accurate. You won't record anything you don't have rights to, such as copyrighted music, in your Source Material.

10. Our promises

We will keep your Twin inside your rules, label videos as required, protect your Source Material, act quickly on misuse reports, and pay you what you earn. If a brand breaks your licence, we will help you enforce it, including by suspending that brand.

11. Liability

EverTwin is responsible for running the platform as described here. Brands are responsible for their products, claims and how they publish your videos. Sections 11 and 12 of the Terms of Service (disclaimers and limitation of liability) apply, but nothing limits liability for misuse of your likeness caused by our breach of these Creator Terms.

12. Changes and contact

We will tell you by email at least 30 days before a material change to these Creator Terms. Changes don't apply to licences you already approved. Questions: contact support or email [email protected].
